These Terms & Conditions govern the use of the PowerFit India website, mobile platforms, fitness centres, kickboxing centres, consulting services, equipment sales, memberships, and any related offerings.
By accessing our website, enrolling as a member, purchasing services, or using our facilities, you agree to be legally bound by these Terms & Conditions.
1. DEFINITIONS
“PowerFit” refers to PowerFit India, its owners, directors, employees, trainers, agents, affiliates, and partners.
“Member” refers to any individual who has purchased or enrolled in any PowerFit service.
“Facility” refers to any PowerFit gym, kickboxing centre, or affiliated training location.
“Membership” includes all gym access plans, PT packages, programs, trials, extensions, and offers.
2. GENERAL WEBSITE & PLATFORM TERMS
2.1 Informational Purpose
Website content is provided for general information only. PowerFit reserves the right to update, modify, suspend, or remove any content, pricing, or offer without prior notice.
2.2 No Guarantee of Availability
Display of services, plans, or offers does not guarantee availability at all locations or times.
3. MEMBERSHIP ENROLLMENT & ACTIVATION
3.1 Activation
Memberships activate only after full payment or agreed payment confirmation.
Activation date is final and binding.
Verbal assurances or informal communication are not valid unless confirmed in writing by authorized management.
3.2 Non-Transferability
Memberships are strictly personal, non-transferable, and non-shareable.
Misuse or sharing credentials may result in termination without refund.
4. PAYMENT, FEES & PRICING
4.1 Payment Obligation
All fees must be paid upfront unless an EMI option is explicitly approved.
EMI arrangements are governed by third-party terms; PowerFit bears no responsibility for EMI disputes

4.2 Price Changes
PowerFit reserves the right to revise prices, plans, or offers at any time. Price changes do not apply retrospectively.
5. NO REFUND POLICY (STRICT)
5.1 General Rule
All payments made to PowerFit are non-refundable, non-reversible, and non-transferable, including but not limited to:
Membership fees
Personal training fees
Registration fees
Promotional offers
Add-on services
5.2 Exceptional Discretion
Any exception (if granted) is:
Solely at PowerFit’s discretion
Not a matter of right
Not a precedent for future cases
FREEZE / HOLD POLICY
6.1 No Automatic Right
Membership freeze or hold is not an entitlement and shall not be considered equivalent to a refund, extension, or compensation.
6.2 Conditional Approval
Freeze may be considered only under exceptional circumstances, such as:
Serious medical conditions
Long-term travel
Government restrictions
Supporting documents may be required.
6.3 Management Discretion
Approval is at the sole discretion of PowerFit management.
PowerFit may approve, modify, shorten, or deny freeze requests without obligation to provide reasons.
6.4 Limitations
Freeze requests must be submitted in advance.
Retrospective freezes are not permitted.
Freeze periods do not apply automatically to PT packages or special offers.
Freeze once approved cannot be reversed or converted into refunds.
7. MEMBERSHIP VALIDITY & EXPIRY
Membership validity is strictly time-bound.
Unused days, sessions, or visits are forfeited upon expiry.
Non-usage does not extend validity.
8. PERSONAL TRAINING (PT) TERMS
8.1 Session Usage
PT sessions must be used within the purchased validity.
Missed sessions without prior notice may be marked as consumed.
8.2 Trainer Assignment
Trainer allocation is subject to availability.
PowerFit reserves the right to reassign trainers if required.
8.3 No Result Guarantee
Results vary based on effort, consistency, lifestyle, and medical factors. PowerFit does not guarantee weight loss, muscle gain, or fitness outcomes.
9. HEALTH & MEDICAL DISCLAIMER
9.1 Member Declaration
Members declare they are medically fit to exercise and have disclosed all relevant conditions.
9.2 No Medical Advice
PowerFit does not provide medical diagnosis, treatment, or prescription.
9.3 Risk Acknowledgement
Members voluntarily assume all risks associated with physical exercise, including injury, strain, or health complications.
10. CONDUCT & DISCIPLINE
PowerFit reserves the right to suspend or terminate membership without refund for:
Misconduct
Abuse toward staff or members
Damage to property
Violation of rules
Safety concerns
13. THIRD-PARTY SERVICES & EQUIPMENT
PowerFit may integrate third-party platforms, apps, payment gateways, or equipment. PowerFit is not liable for failures, delays, or disputes arising from third-party services.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
PowerFit shall not be liable for indirect, incidental, or consequential damages.
Liability, if any, shall be limited to the amount paid by the member for the specific service.
15. FORCE MAJEURE
PowerFit shall not be liable for disruptions caused by events beyond control, including but not limited to:
Natural disasters
Government orders
Pandemics
Strikes
Technical failures
16. GOVERNING LAW MAJEURE & JURISDICTION
These Terms are governed by the laws of India.
Jurisdiction shall lie exclusively with courts in Jaipur, Rajasthan, India.
17. MODIFICATION OF TERMS
PowerFit reserves the right to amend these Terms & Conditions at any time. Continued use of services constitutes acceptance of updated terms.
FINAL LEGAL STATEMENT
By enrolling, paying, or using PowerFit services, you confirm that you have read, understood, and accepted these Terms & Conditions voluntarily and without coercion.
